When should you appoint an independent workplace investigator?

Many workplace investigations can be handled internally. However, there are circumstances where appointing an external investigator can provide greater independence, credibility and confidence in the process.

The seriousness of an allegation is not the only factor. In many cases, the key question is whether the organisation can conduct an investigation that all parties can reasonably have confidence in.

An independent workplace investigator may be particularly appropriate where:

  • allegations involve a senior leader, director or member of the executive team
  • HR or a member of the management team is directly involved in the matter
  • there is an actual or perceived conflict of interest
  • the issues are particularly sensitive or complex
  • allegations involve bullying, harassment, discrimination or whistleblowing
  • there are concerns about whether an internal investigation would be seen as impartial
  • the organisation does not have sufficient internal capacity or investigation expertise
  • previous attempts to address the matter internally have not resolved the issue
  • the investigation requires a level of independence that would be difficult to achieve internally

How our workplace investigation process works

Every investigation is different. We agree the approach with you at the outset so that the process is appropriate to the nature and complexity of the matter.

A typical investigation may include:

1. Initial discussion and scope

We discuss the background, the allegations or concerns that have been raised and what the organisation needs the investigation to establish.

Where appropriate, we help ensure the terms of reference are clear, proportionate and capable of being investigated.

2. Investigation planning

We identify the likely witnesses, relevant documentation and other evidence required to address the terms of reference.

This creates a structured investigation plan while retaining sufficient flexibility to follow relevant evidence as it emerges.

3. Evidence review

We review relevant material such as correspondence, policies, meeting records, contemporaneous documents and other available evidence.

4. Investigation interviews

We conduct confidential interviews with the complainant, respondent and relevant witnesses.

Our approach is professional and impartial, giving individuals an appropriate opportunity to explain their account while ensuring the investigation remains focused on the issues within scope.

5. Evaluation of the evidence

We consider the evidence as a whole, including areas where accounts are consistent, where they conflict and whether the available evidence supports particular findings.

6. Investigation report

We produce a clear written report setting out the investigation process, relevant evidence, findings and the reasoning supporting those findings.

The report provides the organisation with a robust factual basis from which to determine any subsequent action.

A proportionate approach to workplace investigations

A good investigation should be thorough, but that does not mean every matter requires an extensive process.

One of the most important judgements is determining what level of investigation is proportionate to the issues being considered.

Where appropriate, we will challenge unnecessary complexity and keep the investigation focused on the questions that genuinely need to be answered.

Equally, if evidence indicates that an issue requires further exploration, we will ensure relevant matters are properly examined rather than pursuing an artificially narrow process.

Do all workplace complaints need a formal investigation?

No.

Not every workplace conflict or complaint is best resolved through a formal investigation.

​

Depending on the circumstances, an organisation may achieve a better outcome through informal management intervention, facilitated conversations, mediation or another form of early resolution.
